Terms of Service

These Terms govern your use of HSA IQ at hsaiq.com, operated by Orchard Labs LLC, a Wyoming limited liability company. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

HSA IQ is a subscription web application that helps Health Savings Account holders track medical expenses, store receipts, verify expense eligibility, manage reimbursements, import data from external sources, and generate reports. The Service includes OCR for receipt images, an eligible expense database based on IRS Section 213(d) categories, family member expense tracking, data export, and optional cloud backup.

Eligibility

You must be at least 18 years of age and a resident of the United States to use the Service. By creating an account, you represent that you meet these requirements and that the information you provide is accurate.

Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at help@hsaiq.com if you become aware of unauthorized use.

Subscription and Payment

All plans include a 14-day free trial. A valid payment method is required to start a trial. If you do not cancel before the trial ends, you will be charged automatically.

Family plans provide a single account that tracks expenses for the account holder, spouse, and dependents. Family plans do not provide separate logins for family members.

Payment Processing

Payments are processed by a third-party payment processor. We do not receive, process, or store your full credit card number.

Cancellation

You may cancel at any time through the customer portal in your account settings. Cancellation takes effect at the end of your current billing period.

Upon cancellation, we prompt you to export your data. We retain your data for up to 60 days after cancellation, after which we permanently delete your account and all associated data. Lifetime plan holders may request account closure at any time; the same retention and deletion process applies.

Refunds

We do not offer refunds for annual subscriptions after the 14-day trial period. Lifetime purchases are non-refundable. If you believe you were charged in error, contact help@hsaiq.com.

Your Data

Ownership

You retain all ownership rights to the data you provide, including expense records, receipt images, family member information, and reimbursement records. We do not claim ownership of your data.

License to Operate the Service

By using the Service, you grant us a limited, non-exclusive license to store, process, display, and transmit your data solely to provide the Service to you. This includes processing data you import from external sources, transmitting receipt images for OCR processing, and transmitting data to your cloud storage if you enable backup.

Data Portability

You may export your data at any time. Export features provide expense records in CSV format and receipt images via individual download links.

Data Deletion

You may request deletion at any time as described in our Privacy Policy. Requests are processed within 30 calendar days.

Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to the Service or our systems
Interfere with or disrupt the Service
Upload malicious code
Use the Service to store content unrelated to HSA expense tracking
Resell or provide the Service to third parties
Use automated means to access the Service without our prior written consent

We reserve the right to suspend or terminate your account for violation of these Terms.

Eligible Expense Information

Not Tax Advice

The eligible expense checker is based on IRS Section 213(d) and IRS Publication 502. It is for informational purposes only. It is not tax advice, legal advice, or a guarantee of eligibility for any specific expense.

Eligibility Determination Liability

The IRS imposes a 20% additional tax on HSA distributions used for non-qualified expenses (IRC Section 223(f)(4)). If you rely on the Service's eligibility information and an expense is later determined to be ineligible, we are not responsible for any taxes, penalties, interest, or other costs. You are solely responsible for verifying eligibility with a qualified tax advisor.

OCR Accuracy

OCR results are presented for your review and correction before being saved. We do not guarantee accuracy. You are responsible for reviewing and correcting all extracted data.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure; that the eligible expense database is complete or accurate for your situation; or that OCR extraction will be accurate.

We are not a tax advisor, financial advisor, legal advisor, or healthcare provider. Nothing in the Service constitutes tax, financial, legal, or medical advice.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORCHARD LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE; TAX PENALTIES OR INTEREST; IRS AUDIT COSTS; OR DAMAGES ARISING FROM RELIANCE ON INFORMATION PROVIDED BY THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED DOLLARS ($100).

Indemnification

You agree to indemnify and hold harmless Orchard Labs LLC from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: your use of the Service, your violation of these Terms, or any tax liability arising from your reliance on information provided by the Service.

Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.

Informal Resolution

Before filing any formal proceeding, you agree to contact help@hsaiq.com and attempt to resolve the dispute informally for at least 30 days.

Jurisdiction

Any legal action shall be brought in the state or federal courts located in Wyoming. You consent to the personal jurisdiction of these courts.

Changes to These Terms

We will notify you of material changes by email and by posting updated Terms at hsaiq.com. Continued use after changes are posted constitutes acceptance. If you do not agree, you must stop using the Service and cancel your subscription.

Termination

We may suspend or terminate your access for violation of these Terms or at our discretion, with notice to you. Upon termination, we will provide an opportunity to export your data before deletion, unless termination is due to illegal activity or abuse.

Miscellaneous

Entire agreementThese Terms, together with our Privacy Policy and Consumer Health Data Privacy Policy, constitute the entire agreement between you and Orchard Labs LLC regarding the Service
SeverabilityIf any provision is held unenforceable, the remaining provisions remain in full force
No waiverFailure to enforce any provision does not constitute a waiver
AssignmentYou may not assign your rights under these Terms without our consent. We may assign without restriction
Force majeureWe are not liable for failure or delay due to circumstances beyond our reasonable control
